The North Dakota Century Code Chapter 23-09 empowers the North Dakota Department of Health, Division of Food and Lodging to enforce the North Dakota Requirements for Food and Beverage Establishments (North Dakota Administrative Code 33-33-04).  Custer Health has a Memorandum of Understanding with the North Dakota Department of Health, Division of Food and Lodging for Retail Food Stores, Bakeries, Limited Restaurants, Restaurants, Bar/Taverns, and Non-Licensed Commercial Kitchens.

North Dakota Cottage Food Law:
During North Dakota's 2017 legislative session, House Bill 1433 was passed regarding direct producer to consumer sales of cottage food products. The new legislation is effective August 1, 2017.
